Notice of Privacy Practices

This notice describes how medical and health information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Important Notice

This Notice of Privacy Practices applies to protected health information maintained by Changing Endings Behavioral Health Services, LLC, referred to as “CEBHS,” “we,” “us,” or “our.”

This notice explains how CEBHS may use and disclose health information about you, your rights regarding your health information, and certain legal duties CEBHS has regarding your information.

This notice does not create a provider-client relationship by itself. Services, intake, consent, and eligibility may require additional documents.

1. Our Legal Duties

CEBHS is required by applicable law to:

  • Maintain the privacy and security of protected health information.
  • Provide this Notice of Privacy Practices.
  • Follow the duties and privacy practices described in this notice.
  • Notify affected individuals following a breach of unsecured protected health information when required by law.
  • Not use or share your information other than as described here unless authorized by you or allowed by law.

CEBHS may change the terms of this notice. If we make a material change, the updated notice will apply to information we already have and information we receive in the future. The updated notice will be made available on this website.

2. How We May Use and Disclose Health Information

CEBHS may use and disclose your protected health information for treatment, payment, and health care operations.

Treatment

We may use or share your health information to provide, coordinate, or manage services, support, referrals, care planning, or communication with other providers involved in your care when permitted by law.

Payment

We may use or share your health information to bill and receive payment for services, determine eligibility, coordinate benefits, process claims, or communicate with insurance plans or other payment sources when applicable.

Health Care Operations

We may use or share your health information to operate CEBHS, improve services, train staff, manage records, conduct quality review, complete audits, support compliance, and perform other administrative activities.

3. Examples of Common Uses

CEBHS may use or disclose health information to:

  • Contact you about appointment requests, scheduling, reminders, or follow-up.
  • Respond to questions or service-related needs.
  • Coordinate care or referrals when appropriate and permitted.
  • Maintain treatment, support, or service records.
  • Document services provided.
  • Communicate with authorized representatives or support persons when allowed by law and consent.
  • Work with business associates who help CEBHS operate, such as billing, technology, compliance, hosting, records, or administrative service providers.

4. Uses and Disclosures Where You May Have Choices

In some situations, you may tell CEBHS your preferences about how your information is shared. If you have a clear preference, please tell us.

These situations may include:

  • Sharing information with family members, friends, caregivers, or others involved in your care.
  • Sharing information in a disaster relief situation.
  • Communicating with you in a certain way or at a certain location.

CEBHS may follow your instructions when possible and when permitted by law. In some cases, CEBHS may be unable to follow a requested preference if it would interfere with care, safety, legal obligations, or required operations.

5. Uses That Usually Require Written Authorization

CEBHS will generally need your written authorization before using or disclosing your protected health information for:

  • Most uses and disclosures of psychotherapy notes, if maintained by CEBHS.
  • Marketing purposes, when authorization is required by law.
  • The sale of protected health information.
  • Other uses and disclosures not described in this notice or otherwise permitted by law.

If you give written authorization, you may revoke it in writing at any time, except to the extent CEBHS has already relied on it.

6. Your Rights Regarding Your Health Information

You have rights regarding your protected health information. Some rights may be subject to legal limits, verification, fees, timing requirements, or exceptions.

Right to Inspect and Receive a Copy

You may request to inspect or receive a copy of certain health records maintained by CEBHS. CEBHS may provide records in the format required or permitted by law.

Right to Request a Correction

You may ask CEBHS to correct or amend health information you believe is incorrect or incomplete. CEBHS may deny the request in certain circumstances and will explain the decision as required by law.

Right to Request Confidential Communications

You may ask CEBHS to contact you in a specific way or at a specific location. CEBHS will accommodate reasonable requests when required by law.

Right to Request Restrictions

You may ask CEBHS not to use or disclose certain health information for treatment, payment, or health care operations. CEBHS is not always required to agree to the request, except where required by law.

Right to an Accounting of Disclosures

You may request a list of certain disclosures CEBHS made of your health information. This list may not include all disclosures, such as disclosures for treatment, payment, health care operations, or disclosures made with your authorization.

Right to a Paper Copy

You may request a paper copy of this notice at any time, even if you have agreed to receive it electronically.

Right to Receive Breach Notice

You have the right to be notified if CEBHS discovers a breach of unsecured protected health information that affects you, when notice is required by law.

7. Other Uses and Disclosures Allowed or Required by Law

CEBHS may use or disclose health information without your written authorization when allowed or required by law. These may include:

  • Public health activities.
  • Reporting abuse, neglect, or domestic violence when required or permitted by law.
  • Health oversight activities, audits, investigations, inspections, licensing, or compliance reviews.
  • Judicial or administrative proceedings, such as court orders, subpoenas, or other legal process.
  • Law enforcement purposes, when permitted or required by law.
  • To prevent or lessen a serious and imminent threat to health or safety.
  • Workers’ compensation or similar programs.
  • Coroners, medical examiners, or funeral directors when permitted by law.
  • Specialized government functions, such as military, national security, or correctional institution needs, when applicable and permitted by law.
  • Any other use or disclosure required by federal, state, or local law.

8. Substance Use Disorder Records and 42 CFR Part 2

If CEBHS provides services that are subject to federal substance use disorder confidentiality rules under 42 CFR Part 2, certain substance use disorder records may receive additional privacy protections beyond HIPAA.

When 42 CFR Part 2 applies, CEBHS may be limited in how substance use disorder records are used, disclosed, redisclosed, or released. Written consent, a court order, or another legally permitted basis may be required before certain information can be shared.

If Part 2 applies to your records, CEBHS will provide or make available additional information about those rights and restrictions as required by law.

9. Wisconsin Privacy and Treatment Record Requirements

Because CEBHS is located in Wisconsin, Wisconsin laws and regulations may also apply to treatment records, behavioral health records, client rights, confidentiality, consent, release of information, and record access.

If Wisconsin law provides greater privacy protection than federal law in a particular situation, CEBHS will follow the applicable requirement.

10. Minors, Parents, Guardians, and Authorized Representatives

Privacy rights for minors may depend on age, service type, consent, custody, guardianship, applicable Wisconsin law, and other legal factors.

CEBHS may require appropriate documentation before sharing information with a parent, guardian, personal representative, referral source, or other person.

11. Telehealth and Electronic Communication

If CEBHS offers telehealth, video, phone, or electronic communication options, additional consent, safety, privacy, and technology requirements may apply.

You are responsible for participating in telehealth services from a private location when possible. CEBHS may verify your location and emergency contact information when appropriate.

12. Complaints

If you believe your privacy rights have been violated, you may file a complaint with CEBHS using the contact information below.

You may also have the right to file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.

CEBHS will not retaliate against you for filing a complaint.
